Silent Spring Institute--Terms of Use Agreement
YOUR USE OF THE HEALTH AND ENVIRONMENT INFORMATION SYSTEM (HEIS) IS SUBJECT TO THE FOLLOWING TERMS OF USE. YOUR USE OF THE HEIS WILL CONSTITUTE YOUR ACCEPTANCE OF THESE TERMS. IF YOU DO NOT ACCEPT THESE TERMS, YOU ARE NOT PERMITTED TO USE THE HEIS.
I. License and Use
1. The Silent Spring Institute (“SSI”) hereby permits you to use the Health and Environment Information System (“HEIS”), free of any license fee or charge, provided you adhere to each and all of the conditions set forth in these Terms of Use.
2. You may not transfer or reassign this license to any other user, but should direct any prospective user to the HEIS homepage and this Terms of Use Agreement, so the user can become familiar with and accept these Terms of Use if he or she wishes to use any HEIS webpage or dataset.
3. Pursuant to law, data made available by SSI in the HEIS that originated from the Massachusetts Department of Public Health (“MDPH”) may be used only for the purposes for which they were obtained; any effort to determine the identity of any reported cases or to use the information for any purpose other than for health statistical reporting and analysis is prohibited. These data include all spatial and tabular information concerning asthma, birth weight, births to smokers, blood lead, and cancers. SSI acts with great caution to assure that the identity of data subjects cannot be disclosed; all direct identifiers, as well as characteristics that might lead to identifications, are omitted from datasets.
Nevertheless, it may be possible, in rare instances, through complex analysis and/or with outside information, to ascertain the identity of particular persons from a dataset. Considerable harm could ensue if this were done, and the legal rights of others could be infringed by your taking such action. Therefore, SSI requires all users to make, and you hereby make, the following assurances with respect to all datasets accessible by you in using the HEIS:
a. You will not attempt to link, and will not permit others to attempt to link, the dataset with individually-identified records from any other dataset of any other entity.
b. You will not attempt to use the datasets, nor permit others to use them, to learn the identity of any person included in any dataset.
c. If you inadvertently discover the identity of a person, then (1) you will immediately advise SSI of the incident by telephone at (617) 332-4288, or by mail sent to HEIS Coordinator, Silent Spring Institute, Newton, MA 02458; (2) you will safeguard or destroy the information that would identify the individual as requested by SSI; and (3) you will make no further disclosure or use of this identity.
Failure to adhere to the foregoing rules will automatically terminate these Terms of Use and revoke all of your rights to use the HEIS.
4. As noted above, many of these terms are required by, and are included for the benefit of, MDPH. As the intended beneficiary of these contractual requirements, MDPH shall have the right to bring suit in its own name and on its own behalf to enforce these Terms of Use.

II. General Terms.
LINKS AND REFERENCES. This Site hyperlinks to Web sites operated by unrelated parties. These links are provided for your convenience and reference only. SSI does not control these sites and is not responsible for their contents or policies. Our inclusion of these links does not imply any association with or any endorsement or approval of the services, merchandise, materials or contents available from or on these sites. In particular, you should review the Terms of Use and Privacy Policies of these third party sites, since these may differ from SSI’s terms and policies and may be governed by different laws and legal systems.
This Site may contain descriptions of and references to services and entities. These references do not imply our endorsement of them. Under no circumstances shall any of our data or service providers be liable for any loss or damage caused by your reliance on or exposure to information obtained from or contained on the Site.
